Justify the purpose

Every use of patient data by an AI system must have a clearly defined, legitimate purpose. "It might be useful" is not sufficient.

Use minimum necessary information

AI systems should access only the patient data fields required for the specific purpose. Broad data access to "improve" the system is not automatically justified.

Access on need-to-know basis

AI system access to patient data should be controlled, logged, and auditable. The AI system's access credentials and data flows should be as restricted as human access controls.

Understand and comply with the law

NHS organisations must assess the legal basis for AI processing of patient data — under UK GDPR Article 9 (special category data) and applicable NHS-specific legislation. This cannot be delegated to the AI vendor.

Data Security and Protection Toolkit (DSPT)

NHS organisations accessing patient data are required to meet DSPT standards. AI systems processing patient data are within DSPT scope. This includes security controls on the AI system itself, access management, data minimisation in AI processing, and incident response procedures if the AI system is involved in a data incident. Any AI vendor with access to NHS patient data must also demonstrate appropriate security standards — typically ISO 27001 or Cyber Essentials Plus.

MHRA Medical Device Classification

AI software intended for the diagnosis, prevention, monitoring, treatment, or alleviation of disease is classified as a medical device under UK law and requires MHRA registration. This applies to clinical decision support AI, diagnostic AI, and predictive AI used in clinical pathways. Administrative AI (scheduling, documentation transcription, procurement) typically does not meet the medical device definition. The classification decision requires assessment for each specific tool and intended use — it is not a simple categorical determination.

Five Principles for Safe NHS AI Deployment

  1. Start with administrative AI. Applications that do not involve clinical data carry lower governance complexity and allow teams to develop AI implementation capability before tackling clinical applications. Administrative AI success builds the confidence and skills needed for the harder clinical use cases.
  2. Clinical AI requires clinical governance. Any AI system in a clinical pathway must be subject to clinical governance review, not just IT or information governance review. Clinical leads need to understand what the AI does, what its limitations are, and how it interacts with clinical judgement.
  3. Vendor due diligence is non-negotiable. For any AI system processing patient data, the vendor must demonstrate: appropriate security certification, a GDPR-compliant DPA, data residency within the UK or compliant jurisdiction, and clarity on whether patient data is used for model training.
  4. Plan the human oversight before deployment. For clinical AI, the human oversight model — who reviews AI outputs, at what point, and how clinician override is documented — must be defined before the system goes live. Retrofitting oversight after deployment is significantly harder.
  5. Evaluate AI decisions for bias. AI systems trained on historical data may reflect historical biases in healthcare outcomes across demographic groups. For any AI used in clinical pathways, monitoring for differential performance across patient populations is a clinical safety responsibility, not an optional extra.
